Supreme court puts 5-years Islam practice clause on hold in Waqf Act

In a Significant Interim Ruling, The Supreme Court of India has Imposed a Partial Stay on the Waqf (Amendment)  Act,2025, Halting the Controversial Provision that Requires a Person to Practice Islam for Five Year to Create a Waqf.

A Bench Led by Chief Justice BR Gavai Refused to stay that Entire Act but Directed that the clause remain in Abeyance until State Governments frame rules to Determine Eligibility as a Practicing Muslim.

The court highlighted Potential Arbitrariness in Enforcement without such Guidelines.

The Decision came during hearings on Petitions challenging the laws Constitutionality, filed by figures including AIMIM MP Aladdin Owaisi and Congress MP Mohammad Jawed.

The Amendment aim to Enhance Transparency in managing Waqf  properties – Islamic Endowments for charitable purposes but have sparked disputes.

The full hearing on the Act validity is ongoing with the Court Emphasizing protections for Fundamental right and separation of power.
